1. ABOUT THIS PRIVACY POLICY
This Privacy Policy applies to the website owned and operated by EYE REACH PATIENTS, LLC ("ERPLLC "). The "Site" means any website that ERPLLC owns or controls. This Privacy Policy is intended to help you understand how ERPLLC manages information about you.
By using the Site, you consent to ERPLLC's use of your information as described in this Privacy Policy. ERPLLC reserves the right to change this Privacy Policy at any time without advance notice. Should any new policy go into effect, it will be posted on this site, and the revised Privacy Policy will apply only to information collected thereafter. You will be able to determine if this Privacy Policy has been changed since your previous visit by viewing the “Last Updated” information that appears at the bottom of this Privacy Policy. Your continued use of the Site will indicate acceptance of the changes. You may choose to opt-out by discontinuing your use of the Site. Please exit the Site immediately if you do not agree to the terms of this Privacy Policy or any revised policy. Terms used in the Privacy Policy are defined in the Terms of Use.
2. PERSONALLY IDENTIFIABLE AND NON-PERSONALLY IDENTIFIABLE INFORMATION
While you may use the Site without providing personally identifiable information, some of the Services on the Site require that you provide personally identifiable information. If you use the Site without providing personally identifiable information, the only information ERPLLC collects will be non-personal information through the use of cookies or web beacons. If you choose to provide personally identifiable information to ERPLLC for certain Services, you are responsible for ensuring the accuracy of the personally identifiable information you submit to the Site. Inaccurate information will affect the information you receive when using the Site and ERPLLC’s ability to contact you as described in this Privacy Policy. For example, your email address should be kept current because that it is how ERPLLC communicates with you.
As you use the Site, you will be given the option of receiving recurring informational newsletters via email from ERPLLC. In order to subscribe to these newsletters via email, ERPLLC will need your contact information, including name and email address. You can unsubscribe from the newsletters by simply following the directions included at the bottom of each email newsletter you receive from ERPLLC.
If you have difficulties with the unsubscribe or subscribe service, please use the Customer Support Form to write and let ERPLLC know about your problem. ERPLLC Customer Service will manually unsubscribe you from receiving the newsletter within ten (10) days.
Despite ERPLLC’s efforts to protect your personally identifiable information, there is always some risk that an unauthorized third party may find a way around the Site’s security systems or that transmissions of your information over the Internet may be intercepted.
Even if you do not provide personally identifiable information to the Site, ERPLLC collects non-personal information about your use of the Site. ERPLLC may use your personally identifiable and non-personally identifiable information, and allow business partners or affiliates or ours to use it in a manner that is non-personally identifiable, in order to conduct research about use of this Site, user habits and preferences. ERPLLC may use personally identifiable and non-personally identifiable information to send you updates and news regarding the Site and to offer you advertisements and promotions on behalf of itself, or its business partners or affiliates. However, ERPLLC will not share your personally identifiable information with other parties, except as stated in this Policy, or as specifically authorized by you. 3. PERSONAL HEALTH INFORMATION.
You acknowledge that ERPLLC may be providing Services as a health care clearinghouse as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the rules and regulations issued by the United States Department of Health and Human Services (“HHS”) pursuant to HIPAA. You acknowledge that the Services may constitute a covered transaction under HIPAA and that you will comply with HIPAA regarding any information you receive as a result of the Services provided by ERPLLC on this Site.
4. LINKS TO THIRD PARTY WEBSITES.
The Site may contain links to other websites. Once you enter another website (whether through an advertisement, service, or content link), be aware that ERPLLC is not responsible for the privacy practices of these other sites. ERPLLC encourages you to look for and review the privacy statements of each and every web site that you visit through a link or advertisement on ERPLLC. ERPLLC does not disclose your personally identifiable information to these third party websites.
In some cases, when you click on a link or an advertisement on the Site, in an email or newsletter, your browser may be momentarily directed to the website of a third party which, acting on behalf of ERPLLC, notes or “counts” your response to the email or newsletter before redirecting your browser to your selected destination; this redirection process may not be apparent to you.
5. STORAGE OF INFORMATION.
ERPLLC stores user information, including personally identifiable information, on its servers, which may be located in different countries, or on servers of third parties who provide ERPLLC with storage facilities, which may also be in different countries. Any personally identifiable or other information may therefore be used and stored in a country different from yours. ERPLLC may use third parties to process information, including personally identifiable information, for itself. ERPLLC shall require such third parties to abide by this Privacy Policy. ERPLLC shall use its best efforts and industry standard measures, technologies and procedures to preserve the integrity of personally identifiable information and to thwart unauthorized access and use thereof. However, ERPLLC cannot guarantee any personally identifiable information against unauthorized access and use by third parties acting maliciously or in bad faith. If ERPLLC identifies a security breach, involving unauthorized access of a third party to your personally identifiable information, it shall use its best efforts to notify you of such as soon as is reasonably possible, using the contact information that you have previously provided to ERPLLC.
6. INFORMATION YOU SEND TO ERPLLC.
This Privacy Policy does not apply to content, business information, ideas, concepts or inventions that you send to ERPLLC by email or otherwise. If you want to keep content or business information, ideas, concepts or inventions private or proprietary, do not send them to ERPLLC by email or any other method.
7. CHANGES TO YOUR PERSONALLY IDENTIFIABLE INFORMATION; COMPLAINTS.
You may at any time access and modify any accessible personally identifiable information submitted by you (not including email address) by using the Account Profile feature on the site. If you have a complaint or problem, please let ERPLLC know by using the Contact Us link on the Site. If you want to (1) delete your personally identifiable information from ERPLLC’s systems, (2) update the personally identifiable information that you have provided to ERPLLC, or (3) change your preferences with respect to receiving newsletters or other activities, select the Contact Us link on the Site. Upon your request, ERPLLC will delete your personally identifiable information from its active databases and where feasible from its back-up media. Please note that if you chose to modify, or request us to delete any personally identifiable or other information, we may retain copies of the information as originally submitted in order to ensure payment for any Services and as may be required by an order or subpoena issued by a judicial or administrative authority or by a law enforcement agency, or as we may in good faith, consider necessary under law, or upon a request or demand received by us in connection with a legal complaint, claim, suit or procedure. 8. MISCELLANEOUS.
This Policy does not govern the collection or use of information by third parties, such as advertisers on the Site. For information on how third parties collect and use information, please consult the Privacy Policies of those third parties. The headings to this Privacy Policy are intended for convenience only and shall not be used for interpretation. If any provision or provisions of this Privacy Policy should be held to be unenforceable, such holding will not affect the other provisions hereof which shall remain in full force. This site is owned and operated by Eye Reach Patients, LLC, a Florida limited liability company, and is designed to conform to the laws of the State of Florida. If you are viewing or using this site from another country, please be aware that you will be transferring information outside of your country. Your continued access and use of this site will indicate your consent to this. This Privacy Policy shall be governed and construed under the laws of the State of Florida, USA, without regard to its conflicts of laws. Exclusive jurisdiction over any dispute arising out of or under this Privacy Policy shall be with the state or federal court in Broward County, Florida, USA. You hereby waive any right to file a claim in any other jurisdiction, including forum non conveniens.
